1 MIXMASTER LICENSE AGREEMENT

3 1. Grant of License.

5 Anonymizer Inc. grants you the following non-exclusive license for
6 the Mixmaster program and its associated documentation (the "Program"),
7 subject to all of the following terms and conditions:

9 a) You may use the Program, and copy and distribute verbatim copies
10 of the Program as you receive it, in any medium.

12 Local regulations may exist which limit your rights to distribute or
13 use cryptographic software. In certain jurisdictions, parts of this
14 software are protected by patents. It is your responsibility to
15 obtain the appropriate licenses.

17 b) You may modify the Program or incorporate the Program or any
18 portion of it into other computer programs. You may copy and
19 distribute such modifications or work, provided that you:

21 (i) cause the modified Program to carry a prominent notice
22 stating that it has been modified, and cause the modified files
23 to carry notices stating that you changed the files and the
24 date of any change;

26 (ii) reproduce and include this Agreement, the copyright
27 notices and disclaimer of warranty on any copy; and

29 (iii) provide Anonymizer Inc. with a copy of the Source Code of
30 such modifications or work by electronic mail, and grant
31 Anonymizer Inc. a perpetual, royalty-free license to use and
32 distribute the modifications or work in its products.

34 "Source Code" means the preferred form of a work for making
35 modifications to it, including all modules it contains, plus
36 any associated interface definition files, scripts used to
37 control compilation and installation of an executable.

39 2. Reservation of Rights.

41 No rights are granted to the Program except as expressly set forth
42 herein. You may not copy, modify, sublicense, or distribute the
43 Program except as expressly provided under this Agreement. Any
44 attempt otherwise to copy, modify, sublicense or distribute the
45 Program is void, and will automatically terminate your rights under
46 this Agreement.

48 3. DISCLAIMER OF WARRANTY.

50 BECAUSE THE PROGRAM IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTY
51 FOR THE PROGRAM, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE
52 PROGRAM IS PROVIDED ON AN ``AS IS'' BASIS, WITHOUT WARRANTY OF ANY
53 KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION,
54 WARRANTIES THAT THE PROGRAM IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR
55 A PARTICULAR PURPOSE OR NON-INFRINGING. THE ENTIRE RISK AS TO THE
56 QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE
57 PROGRAM PROVE DEFECTIVE IN ANY RESPECT, YOU (NOT ANONYMIZER INC. OR
58 ANY DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE COST OF ANY
59 NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER OF
60 WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF THE
61 PROGRAM IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.

63 4. LIMITATION OF LIABILITY.

65 UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
66 (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL ANONYMIZER INC.
67 OR ANY DEVELOPER OR ANY OTHER CONTRIBUTOR OR ANY SUPPLIER OF ANY OF
68 SUCH PARTIES, BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT,
69 SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
70 INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK
71 STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
72 COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN
73 INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF
74 LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY
75 RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW
76 PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE
77 EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
78 THAT EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.

80 5. General.

82 This license represents the complete agreement concerning subject
83 matter hereof. If any provision of this Agreement is held to be
84 unenforceable, such provision shall be reformed only to the extent
85 necessary to make it enforceable. This Agreement shall be governed by
86 California law provisions (except to the extent applicable law, if
87 any, provides otherwise), excluding its conflict-of-law provisions.
88 The application of the United Nations Convention on Contracts for the
89 International Sale of Goods is expressly excluded. Any law or
90 regulation which provides that the language of a contract shall be
91 construed against the drafter shall not apply to this License.
