25 "Technology" means the source code, object code and specifications of
26 the technology made available by Sun pursuant to this License.

28 "Technology Site" means the website designated by Sun for accessing the

31 "You" means the individual executing this License or the legal entity or

34 II. PURPOSE.

57 license of Your choice that is consistent with this License; and publish

59 excerpts that do not in the aggregate constitute a significant portion

62 B. Residual Rights. You may use any information in intangible form that
63 you remember after accessing the Technology, except when such use

68 all rights, title, and interest in Your Modifications and associated

72 with notices and open source licenses from open source communities and
73 third parties that govern the use of those portions, and any licenses
74 granted hereunder do not alter any rights and obligations you may have

76 limitation of liability provisions in this License will apply to all

117 Sun's posting of notice of suspension on the Technology Site.

173 ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF THESE TERMS BY SELECTING THE

179 1. LICENSE TO USE. Sun grants you a non-exclusive and non-transferable
180 license for the internal use only of the accompanying software and
181 documentation,the Java Advanced and any error corrections provided by
182 Sun (collectively "Software"), by the number of users and the class of
183 computer hardware for which the corresponding fee has been paid.

185 2. RESTRICTIONS. Software is confidential and copyrighted. Title to
186 Software and all associated intellectual property rights is retained by
187 Sun and/or its licensors. Except as specifically authorized in any
188 Supplemental License Terms, you may not make copies of Software, other
189 than a single copy of Software for archival purposes. Unless
190 enforcement is prohibited by applicable law, you may not modify,
191 decompile, or reverse engineer Software. Licensee acknowledges that
192 Software is not designed or intended for use in the design,
193 construction, operation or maintenance of any nuclear facility. Sun
194 Microsystems, Inc. disclaims any express or implied warranty of fitness
195 for such uses. No right, title or interest in or to any trademark,
196 service mark, logo or trade name of Sun or its licensors is granted
197 under this Agreement.

199 3. LIMITED WARRANTY. Sun warrants to you that for a period of ninety
200 (90) days from the date of purchase, as evidenced by a copy of the
201 receipt, the media on which Software is furnished (if any) will be free
202 of defects in materials and workmanship under normal use. Except for the
203 foregoing, Software is provided "AS IS". Your exclusive remedy and
204 Sun's entire liability under this limited warranty will be at Sun's
205 option to replace Software media or refund the fee paid for Software.

207 4. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS AGREEMENT, ALL
208 EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING
209 ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
210 PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT
211 THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

213 5. LIMITATION OF LIABILITY. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO
214 EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT
215 OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE
216 DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING
217 OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE, EVEN IF
218 SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event
219 will Sun's liability to you, whether in contract, tort (including
220 negligence), or otherwise, exceed the amount paid by you for Software
221 under this Agreement. The foregoing limitations will apply even if the
222 above stated warranty fails of its essential purpose.

224 6. Termination. This Agreement is effective until terminated. You may
225 terminate this Agreement at any time by destroying all copies of
226 Software. This Agreement will terminate immediately without notice from
227 Sun if you fail to comply with any provision of this Agreement. Upon
228 Termination, you must destroy all copies of Software.

230 7. Export Regulations. All Software and technical data delivered under
231 this Agreement are subject to US export control laws and may be subject
232 to export or import regulations in other countries. You agree to comply
233 strictly with all such laws and regulations and acknowledge that you
234 have the responsibility to obtain such licenses to export, re-export, or
235 import as may be required after delivery to you.

237 8. U.S. Government Restricted Rights. If Software is being acquired by
238 or on behalf of the U.S. Government or by a U.S. Government prime
239 contractor or subcontractor (at any tier), then the Government's rights
240 in Software and accompanying documentation will be only as set forth in
241 this Agreement; this is in accordance with 48 CFR 227.7201 through
242 227.7202-4 (for Department of Defense (DOD) acquisitions) and with 48
243 CFR 2.101 and 12.212 (for non-DOD acquisitions).

245 9. Governing Law. Any action related to this Agreement will be
246 governed by California law and controlling U.S. federal law. No choice
247 of law rules of any jurisdiction will apply.

249 10. Severability. If any provision of this Agreement is held to be
250 unenforceable, this Agreement will remain in effect with the provision
251 omitted, unless omission would frustrate the intent of the parties, in
252 which case this Agreement will immediately terminate.

254 11. Integration. This Agreement is the entire agreement between you and
255 Sun relating to its subject matter. It supersedes all prior or
256 contemporaneous oral or written communications, proposals,
257 representations and warranties and prevails over any conflicting or
258 additional terms of any quote, order, acknowledgment, or other
259 communication between the parties relating to its subject matter during
260 the term of this Agreement. No modification of this Agreement will be
261 binding, unless in writing and signed by an authorized representative of
262 each party.

266 SUPPLEMENTAL LICENSE TERMS

268 These supplemental license terms ("Supplemental Terms") add to or modify
269 the terms of the Binary Code License Agreement (collectively, the
270 "Agreement"). Capitalized terms not defined in these Supplemental Terms
271 shall have the same meanings ascribed to them in the Agreement. These
272 Supplemental Terms shall supersede any inconsistent or conflicting terms
273 in the Agreement, or in any license contained within the Software.

275 1. Software Internal Use and Development License Grant. Subject to the
276 terms and conditions of this Agreement, including, but not limited to
277 Section 3 (Java Technology Restrictions) of these Supplemental Terms,
278 Sun grants you a non-exclusive, non-transferable, limited license to
279 reproduce internally and use internally the binary form of the Software
280 and the Java Advanced Imaging and the JAI Image I/O Open Source Project,
281 complete and unmodified, for the sole purpose of designing, developing
282 and testing your Java applets and applications ("Programs").

284 2. License to Distribute Software. In addition to the license granted
285 in Section 1 (Software Internal Use and Development License Grant) of
286 these Supplemental Terms, subject to the terms and conditions of this
287 Agreement, including but not limited to, Section 3 (Java Technology
288 Restrictions) of these Supplemental Terms, Sun grants you a
289 non-exclusive, non-transferable, limited license to reproduce and
290 distribute the Software in binary code form only, provided that you (i)
291 distribute the Software complete and unmodified and only bundled as part
292 of your Programs, (ii) do not distribute additional software intended to
293 replace any component(s) of the Software, (iii) do not remove or alter
294 any proprietary legends or notices contained in the Software, (iv) only
295 distribute the Software subject to a license agreement that protects
296 Sun's interests consistent with the terms contained in this Agreement,
297 (v) agree to defend and indemnify Sun and its licensors from and against
298 any damages, costs, liabilities, settlement amounts and/or expenses
299 (including attorneys' fees) incurred in connection with any claim,
300 lawsuit or action by any third party that arises or results from the use
301 or distribution of any and all Programs and/or Software, and (vi) bundle
302 the Software with the implementation of the Java Advanced Imaging and
303 the JAI Image I/O Open Source Project.

305 3. Java Technology Restrictions. You may not modify the Java Platform
306 Interface ("JPI", identified as classes contained within the "java"
307 package or any subpackages of the "java" package), by creating
308 additional classes within the JPI or otherwise causing the addition to
309 or modification of the classes in the JPI. In the event that you create
310 an additional class and associated API(s) which (i) extends the
311 functionality of the Java platform, and (ii) is exposed to third party
312 software developers for the purpose of developing additional software
313 which invokes such additional API, you must promptly publish broadly an
314 accurate specification for such API for free use by all developers. You
315 may not create, or authorize your licensees to create additional
316 classes, interfaces, or subpackages that are in any way identified as
317 "java", "javax", "sun" or similar convention as specified by Sun in any
318 naming convention designation.

320 4. Java Runtime Availability. Refer to the appropriate version of the
321 Java Runtime Environment binary code license (currently located at
322 http://www.java.sun.com/jdk/index.html) for the availability of runtime
323 code which may be distributed with Java applets and applications.

325 5. Trademarks and Logos. You acknowledge and agree as between you and
326 Sun that Sun owns the SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET
327 trademarks and all SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET-related
328 trademarks, service marks, logos and other brand designations ("Sun
329 Marks"), and you agree to comply with the Sun Trademark and Logo Usage
330 Requirements currently located at
331 http://www.sun.com/policies/trademarks. Any use you make of the Sun
332 Marks inures to Sun's benefit.

334 6. Source Code. Software may contain source code that is provided solely
335 for reference purposes pursuant to the terms of this Agreement. Source
336 code may not be redistributed unless expressly provided for in this
337 Agreement.

339 7. Termination for Infringement. Either party may terminate this
340 Agreement immediately should any Software become, or in either party's
341 opinion be likely to become, the subject of a claim of infringement of
342 any intellectual property right.
